How do I license @ctiVideoWeb for usage on my website?

@ctiVideoWeb comes in two different versions - Evaluation and Production. Both versions are available in the same CAB file and are distributed together. Both versions are functionally equivalent and have the same interface. The versions have different limitations:

The Evaluation version is intended for development use and can upload unlimited number of single frames and/or video clips to any host, as well as stream from a page, hosted anywhere. The legth of the captured and encoded video is limited to 10 seconds, the length of the live stream is limited to 90 seconds and the captured frames have a horizontal gray line in the middle of the image. The CLSID parameter of the <OBJECT> tag of your web page should be set to "8D10E13A-BC9F-4214-9CC4-89459DA65932" in order to use this version.

The Production version is intended for use in production environment. It doesn't have any limitations on the length of the captured video or the frames. In order to enable this version of the control to upload to your specified host (webserver), you need to obtain a license. The licensing is available in 4 different levels, based on the expected traffic of your web-site.

The licensing is per uploaded video clips/images and comes in 4 levels:

up to 1,000 uploads/year, 10 hours live streaming/year;
up to 10,000 uploads/year, 100 hours live streaming/year;
up to 25,000 uploads/year, 250 hours live streaming/year;
unlimited license

Any unused uploads during a license period cannot be carried over to the next year. The license includes free upgrades to any future service releases/new versions and email support. You can specify up to 3 domain spaces, to which you can upload video clips and images (e.g. if you select activevideotools.com, then you can use the control to upload captured data to any host within that domain space - www.activevideotools.com, uploads.activevideotools.com, etc.). You can dynamically change the domains selected and monitor your usage statistics using the control panel on our website at www.activevideotools.com/webcontrol/

In order to use the production version of the control, the CLSID parameter of the <OBJECT> tag of your web page should be set to "8756DF15-370C-4A0D-875C-CAB8619CE7E7".

END-USER LICENSE AGREEMENT FOR @CTIVIDEOWEB SOFTWARE

IMPORTANT-READ CAREFULLY: This @ctiVideo End-User License Agreement is a legal agreement between you (either an individual or a single entity) and ActiVideo, Inc for the @ctiVideo.Web software product(s) identified above which may include help files , samples projects available to download in the homepage or any other product.

By installing, copying, or otherwise using and testing the SOFTWARE PRODUCT, you agree to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, do not install or use the SOFTWARE PRODUCT.

Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

Your rights and obligations with respect to the use of this Software are as follows

You may :
1. Install the OCXs and use it in your projects
2. Create comercial applications using the controls and distribute it with your executables, no royalties required
3. Create as many applications as you want
4. Receive support by e-mail to answer questions and solve problems referred to the controls

You may not :
1. Create ActiveX OCX , DLLs , or any other derivative tools to be used at design mode in VB , VC++ or any other development tools .
2. Distribute the REGISTERED OCX INSTALLATION program or the license key in any way.
3. Create compiled OCX or DLL without requiring the license key, but to be used at design mode.
4. Use the OCX in any other container that is not a form or web page.
5. Reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source code of the Software.

The following types of sites are NOT allowed to use @ctiVideo.Web software or any derivative products: sites encouraging illegal activity or racism, sites providing instructions or discussions about performing illegal activities, sites that promote or utilize software or services designed to deliver unsolicited email, sites that promote child pornography, or any other sites that we deem to be inappropriate.

This software is not sold, this software is licensed

ActiVideo, Inc grants a license to use the enclosed software to the original purchaser. Copies may be made for back-up purposes only. Copies made for any other purpose are expressly prohibited, and adherence to this requirement is the sole responsibility of the purchaser. Customer written executable applications containing embedded @ctiVideo.Web products may be freely distributed, without royalty payments to ActiVideo, Inc, provided that such distributed @ctiVideo.Web product is bound into these applications in such a way so as to prohibit separate use in design mode, and that such @ctiVideo.Web product is distributed only in conjunction with the customers own software product. The @ctiVideo.Web controls may not be distributed by itself in any form.

Our controls may be used as a constituent control only if the compound control thus created is distributed with and as an integral part of an application. Permission to use this control as a constituent control does not grant a right to distribute the license file or any other file other than the control executable itself. This license may be transferred to a third party only if all existing copies of the software and its documentation are also transferred.

PAYMENT AND SUBSCRIPTION PLANS. You will pay to ActiVideo, Inc. an up-front fee in an amount designated by ActiVideo, Inc. for each subscription plan, for the ability to use the @ctiVideo.Web product for twelve (12) month period. During the applicable subscription period, you may use the @ctiVideo.Web product to upload a limited number of captured images and/or video clips or stream a limited amount of live audio-video data in accordance with the terms of this Agreement. This number varies between different subscription plans and will be explicitly specified at the time of the payment. Any unused number of available uploads or streaming time during a given subscription period will not be carried over to the next period.

ActiVideo, Inc. reserves the right to collect general statistics information about the usage of @ctiVideo.Web software by periodically sending an authorization request to a central license server. This information may include the time of upload and/or live stream, as well as the IP address of the machine, originating the communication and the current upload URL. No personally identifiable information about the visitors and/or users of your website will be collected and/or stored.

We encourage the use of our controls as constituent controls when the compound controls you create are an integral part of your application. But we don't allow distribution of our controls as constituents of other controls when the compound control is not part of an application. The reason we need to have this restriction is that without it someone might decide to use our control as a constituent, add some trivial (or even non-trivial) enhancements and then sell the compound control. Obviously there would be little difference between that and just plain reselling our control.

The shareware versions of our products are intended for evaluation purposes only. You may not use the shareware version to develop completed applications.

ACTIVIDEO INC. SOFTWARE'S LIABILITY IS LIMITED TO THE PURCHASE PRICE. Under no circumstances shall ActiVideo, Inc. or the authors of this product be liable for any incidental or consequential damages, nor for any damages in excess of the original purchase price.

NO WARRANTIES.

ActiVideo, Inc expressly disclaims any warranty for the SOFTWARE PRODUCT.

THE SOFTWARE PRODUCT AND ANY RELATED DOCUMENTATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. YOU AGREE THAT YOU HAVE MADE YOUR OWN DETERMINATION REGARDING THE USEFULNESS OF THE PRODUCT OR SERVICE. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE PRODUCT REMAINS WITH YOU.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL ACTIVIDEO, INC. OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT.

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD US HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, LIABILITY COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM YOUR VIOLATION OF THIS AGREEMENT OR ANY THIRD-PARTY'S RIGHTS, INCLUDING BUT NOT LIMITED TO INFRINGEMENT OF ANY COPYRIGHT, VIOLATION OF ANY PROPRIETARY RIGHT AND INVASION OF ANY PRIVACY RIGHTS. THIS OBLIGATION SHALL SURVIVE ANY TERMINATION OF THIS AGREEMENT.
